Terms and Conditions for Money Back Promotion

The following terms and conditions qualify the offer of Bagnall & Associates, LLC (hereinafter referred to as “B&A”) to refund certain professional setup and consulting service fees in the event you do not double your sales within 12 months of commencing use of B&A services and following the B&A step-by-step process for doubling sales.  Requirements and eligibility for participation in the Promotion include the following:

1. The Promotion is open only to new customers of B&A.

2. You must get your B&A account set up and all your data imported within 30 days of purchasing a B&A subscription.  You must maintain your B&A subscription for at least 12 months and remain current on all payment obligations throughout the term of your subscription.

3. During your B&A subscription you must follow B&A’s step-by-step process for doubling sales, including each of the following minimum steps within the timeframe described:

Within the first two months of commencing your subscription:

  • Post at least two B&A lead capture forms “above the fold” on high traffic pages of your website.
  • Employ at least one automatic B&A nurturing sequence for prospects
  • Employ at least one B&A nurturing sequence for prospects
  • Employ at least one automatic B&A upsell sequence for customers

Within the first three months of commencing your subscription:

  • Make use of the B&A affiliate program to grow your business through partners
  • Sell your products or services through the B&A shopping cart
  • Utilize at least one upsell technique in the B&A shopping cart

Quarterly:

  • Send a broadcast promotion to your prospect list at least once per quarter

To assist you in the following step-by-step process, we will send you a detailed step-by-step All About Spelling How-To-Guide that will explain how B&A helped All About Spelling (www.all-about-spelling.com) to double it sales and show you how to accomplish the steps above.  Note that the step-by-step process is separate from the setup process that your B&A consultant will guide you through when you commence your subscription.

4. To be eligible for the refund, you must cancel your B&A account between 12 and 15 month anniversary of its commencement and request a refund of setup and consulting services fee in writing at the same time you notice your cancellation.  Your refund request must be accompanied by a CPA-approved record of revenue for the prior 18 months, showing that you have not doubled your gross sales revenue for any comparable months from the prior year.

5. If at the end of the 12 month period you fail to double your sales revenue for any comparable month but are pleased with the B&A service and wish to continue using it to grow your business, you (of course) may do so, but you will not be eligible for the refund described in this program.

6. Only the set up and consulting fees previously paid by you to B&A are eligible for refund under this program.  Your monthly subscription charges to B&A are not refundable.

I have read and understand the terms of the Promotion and hereby authorize B&A to charge me for the above total and I agree not to dispute the charges.  I further affirm that the name personal information provided on this form are true and correct.  NOTICES: The monthly Membership Fee will be charged to my card starting now until I say stop.  A usage fee for FAX ($.10/page) and Voice Broadcasting ($.15/minute) will be billed to my credit card the first week of the month for the prior month’s usage.  Credit card payments are processed through 1ShoppingCart’s merchant account as “Bagnall & Associates, LLC.”  I hereby state these transactions are valid and agree not to dispute these charges.  I further declare that I have read, understand and accept B&A’s Privacy, Acceptable Use, and Billing policies for this sale as outlined on www.Brian-Bagnall.com.
